WAIVER AND RELEASE OF LIABILITY FOR PARTICIPATION IN A FIREARM CLASS, INSTRUCTION, AND/OR EVENT

NOTICE: THIS IS A LEGALLY BINDING AGREEMENT. BY SIGNING THIS AGREEMENT YOU GIVE UP YOUR RIGHT TO BRING A COURT ACTION TO RECOVER COMPENSATION OR OBTAIN ANY OTHER REMEDY FOR INJURIES TO YOURSELF OR YOUR PROPERTY ARISING OUT OF YOUR PARTICIPATION IN L&L FIREARMS TRAINING CLASSES OR EVENTS OR YOUR USE OF ITS EQUIPMENT, INCLUDING INJURIES CAUSED BY THE NEGLIGENCE OF THE RELEASED PARTIES. READ THIS AGREEMENT CAREFULLY BEFORE SIGNING.

LEAD EXPOSURE WARNING: AMMUNITION, DISCHARGED FIREARMS, AND SHOOTING RANGE ENVIRONMENTS CAN EXPOSE YOU TO LEAD, KNOWN TO THE STATE OF CALIFORNIA TO CAUSE CANCER AND BIRTH DEFECTS OR OTHER REPRODUCTIVE HARM. L&L FIREARMS TRAINING STRONGLY RECOMMENDS THAT ANYONE WHO IS PREGNANT, MAY BE PREGNANT, OR IS NURSING CONSULT A PHYSICIAN AND REFRAIN FROM SHOOTING OR BEING ON OR NEAR THE RANGE, DUE TO THE KNOWN EFFECTS OF LEAD ON UNBORN CHILDREN AND NURSING INFANTS. ALL PARTICIPANTS SHOULD WASH THEIR HANDS AND FACE THOROUGHLY BEFORE EATING, DRINKING, OR SMOKING. (ALL PARTICIPANTS) Initial in the form below

1. Released Parties and Covered Activities

“Released Parties” means L&L Firearms Training, LLC and its owners, members, officers, instructors, employees, agents, range safety officers, and volunteers; Rainbow Shooting Range and its owners and operators; the owner of the property on which the range is located; and all other class participants. “Activities” means my participation in the class, instruction, or event identified above; my use of firearms, ammunition, targets, and other equipment; and my presence on the classroom or range premises, including travel between areas on site.

2. Assumption of Risk

I am a willing participant and student in a firearms training course, instruction, or event conducted by L&L Firearms Training, LLC. I understand that firearms and ammunition, and any use of them, can cause damage and harm to property and persons and are capable of causing serious injury or death, including from malfunctions, ricochets, hot brass, noise, and the acts of other participants. I fully understand that the Activities are inherently risky and dangerous, and I knowingly and voluntarily accept and assume all such risks, known and unknown.

3. Waiver and Release of Liability

On behalf of myself and my heirs, representatives, administrators, executors, and assigns, and to the fullest extent permitted by California law, I fully, irrevocably, and forever waive, release, and discharge the Released Parties from any and all claims, demands, causes of action, costs, expenses, fees (including attorneys’ and court fees), and liabilities for personal injury, death, or property damage arising out of or relating to the Activities, INCLUDING CLAIMS ARISING FROM THE NEGLIGENCE OF THE RELEASED PARTIES. Consistent with California Civil Code § 1668, this release does not apply to, and does not purport to release, claims arising from gross negligence, willful misconduct, fraud, or violations of law.

4. Covenant Not to Sue

I agree that I, and anyone claiming on my behalf, will not sue or bring any claim, action, or proceeding against any of the Released Parties for any matter released in this Agreement. If I breach this covenant, I agree to pay the reasonable attorneys’ fees and costs the Released Parties incur in defending against such action.

5. Indemnification

To the fullest extent permitted by California law, I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, losses, damages, liabilities, and expenses (including reasonable attorneys’ fees) caused by my own acts or omissions during the Activities, including any claims brought by my heirs, family members, or guests.

7. Medical Authorization

I consent to the administration of first aid and emergency medical care, and to transport to a medical facility, as deemed necessary by L&L Firearms Training, its instructors, range staff, or emergency personnel. I understand that any such care and transport will be at my own expense.

8. General Provisions

Severability: If any portion of this Agreement is held invalid or unenforceable, the remainder shall continue in full force and effect, and the invalid portion shall be enforced to the maximum extent permitted by law. Governing Law: This Agreement is governed by the laws of the State of California. Entire Agreement: This Agreement is the entire agreement between me and the Released Parties regarding its subject matter and supersedes any prior oral or written statements. Electronic Signatures: An electronic signature on this Agreement is valid and has the same legal effect as a handwritten signature (California Civil Code § 1633.7).

I, THE UNDERSIGNED, ACKNOWLEDGE, AFFIRM, AND AGREE THAT I HAVE READ, AND HAVE HAD SUFFICIENT TIME TO REVIEW, THIS WAIVER AND RELEASE OF LIABILITY PRESENTED TO ME BY L&L FIREARMS TRAINING, LLC. I UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL RIGHTS, AND I SIGN IT VOLUNTARILY. THE DETAILS OF THIS WAIVER AND RELEASE OF LIABILITY HAVE BEEN AGREED UPON AND ARE HEREBY ACKNOWLEDGED BY MY SIGNATURE BELOW.

PARENT/LEGAL GUARDIAN CONSENT (REQUIRED IF PARTICIPANT IS UNDER 18)

I am the parent or legal guardian of the minor participant named above. I have read this Agreement and, on my own behalf and on behalf of the minor, consent to the minor’s participation and agree to all of its terms, INCLUDING THE WAIVER AND RELEASE OF CLAIMS (INCLUDING CLAIMS ARISING FROM THE NEGLIGENCE OF THE RELEASED PARTIES), THE COVENANT NOT TO SUE, AND THE INDEMNIFICATION OF THE RELEASED PARTIES, to the fullest extent permitted by California law. I also give the medical authorization above on the minor’s behalf. I agree to remain present for the entire course or event.
